Terms and Conditions

How To Overcome Betrayal LLC

Effective Date: September 12, 2026

These Terms and Conditions ("Terms") govern use of overcomebetrayal.com (the "Site"), account and portal access, purchases of physical and digital products, and other interactions with How To Overcome Betrayal LLC ("Company," "we," "us," or "our") that are not governed by a separate signed agreement.

When we ask you to affirmatively accept these Terms, including through a checkout checkbox, account-creation flow, button, or other clear electronic acceptance method, your acceptance creates an agreement to these Terms. Website access is also subject to the use and conduct rules below.

A signed Private Coaching Agreement controls the private coaching relationship if it contains terms that are different from or more specific than these Terms. The Refund & Cancellation Policy governs general refund, cancellation, rescheduling, and product-return rules. The Privacy Policy describes our data practices. A general website policy does not silently amend an already-signed Coaching Agreement.

1. SCOPE, ACCEPTANCE, AND DOCUMENT HIERARCHY

These Terms apply to Site use, public resources, account and portal access, product purchases, and other online interactions with the Company. They do not replace a signed Coaching Agreement, product-specific terms clearly presented at purchase, or rights that applicable law does not permit the parties to waive.

If documents conflict, the signed Coaching Agreement controls private coaching services; the Refund & Cancellation Policy controls general refund and cancellation matters unless the signed Coaching Agreement is more specific; the Privacy Policy controls data-practice disclosures; and product-specific terms accepted at purchase control that product to the extent they do not conflict with nonwaivable law.

You should retain or print a copy of these Terms for your records.

2. ELIGIBILITY AND MINORS

The Site and services are primarily designed for adults. You must have legal capacity to enter the transaction you are attempting. If you are under eighteen, a parent or legal guardian must authorize purchases, account creation, or other transactions when required by law or by the applicable service.

We do not accept children under thirteen for private coaching and do not knowingly permit children under thirteen to create coaching accounts. Private coaching for participants ages thirteen through seventeen requires the involvement and written consent of a parent or legal guardian together with the minor-participant process required by the Company.

3. WEBSITE, ACCOUNT, AND ACCEPTABLE USE

You may use the Site, accounts, portal, and Company resources only for lawful purposes and in a manner that does not interfere with the Site, other users, or Company systems.

You may not:

  • attempt to gain unauthorized access to an account, system, server, database, or restricted area;
  • bypass security, access controls, rate limits, or technical protections;
  • introduce malware, harmful code, automated abuse, or other destructive material;
  • impersonate another person or provide materially false account information;
  • share account credentials in a way that permits unauthorized access;
  • use Company content or systems for unlawful harassment, threats, fraud, infringement, or other illegal conduct;
  • scrape, copy, harvest, or automate access in a manner that violates law, infringes rights, bypasses controls, or places an unreasonable burden on the Site; or
  • use Company intellectual property for unauthorized commercial exploitation.

You are responsible for maintaining the confidentiality of credentials associated with your account and for promptly notifying us if you reasonably believe your account has been compromised.

4. NON-CLINICAL COACHING NOTICE AND PRIVATE COACHING

How To Overcome Betrayal LLC provides non-clinical betrayal recovery coaching, educational resources, self-reflection tools, and personal-development support. Coaching is not psychotherapy, professional mental-health counseling, psychiatric care, medical treatment, diagnosis, treatment planning, crisis intervention, legal advice, or another licensed clinical service.

If you believe there is an immediate danger of self-harm, harm to another person, or another emergency, contact 911, 988, local emergency services, or an appropriate licensed professional or crisis resource. The Site, portal, email, and text channels are not continuously monitored emergency services.

Private coaching is governed by the applicable signed Coaching Agreement. That agreement addresses package structure, payment, capacity reservation, scheduling, recording, confidentiality, intellectual property, termination, dispute resolution, and other coaching-specific matters. Results vary, and the Company does not guarantee reconciliation, preservation or termination of a relationship, emotional recovery by a particular date, financial results, legal outcomes, or another specific coaching result.

These Terms do not themselves constitute consent to record a coaching session. Recording consent and recording practices are governed by the applicable signed Coaching Agreement and the Privacy Policy. Under the Company’s current private-coaching process, recording is a standard component when required by the signed agreement, with advance written consent and a verbal reminder at or near the beginning of a recorded session.

5. ORDERS, PRICES, PAYMENTS, PHYSICAL PRODUCTS, AND SHIPPING

Prices, product descriptions, availability, shipping charges, taxes, and payment options are shown through the applicable product, checkout, invoice, or payment flow. You agree to provide accurate billing, shipping, contact, and transaction information.

Payments may be processed by third-party payment providers. Those providers may impose lawful terms, processing rules, interest, financing terms, or fees that the Company does not control. We do not store full payment-card credentials when they are handled directly by the applicable payment processor.

We may decline or cancel an order before fulfillment when reasonably necessary because of suspected fraud, a material pricing or inventory error, an inability to fulfill the order, legal restrictions, or another legitimate transaction issue. If we cancel an order after collecting payment, we will refund the amount we received for the cancelled portion as required by law and the applicable transaction terms.

Physical-product shipping, damaged or defective items, incorrect items, lost or undelivered orders, shipping delays, and shipping-cost treatment are governed by the Refund & Cancellation Policy and applicable law. Nothing in these Terms eliminates a buyer’s nonwaivable rights concerning goods that are not delivered as represented.

6. REFUNDS, CANCELLATIONS, RESCHEDULING, AND PAYMENT DISPUTES

The Refund & Cancellation Policy is incorporated into these Terms for general website and product transactions and for public explanations of coaching refund and cancellation practices. A signed Coaching Agreement controls if it contains different or more specific coaching terms.

The Refund & Cancellation Policy currently addresses, among other matters, pre-session coaching cancellations, capacity-reservation calculations, post-start package termination, rescheduling, late arrivals, no-shows, third-party processing charges, physical products, digital products, replacements, refund timing, and payment disputes.

A chargeback or payment dispute does not automatically replace the contractual terms governing the transaction, but nothing in these Terms prevents a consumer from exercising a lawful right to dispute a transaction with a card issuer, payment processor, financing provider, or other institution.

7. DIGITAL PRODUCTS, DOWNLOADS, AND LICENSED ACCESS

Digital products, eBooks, downloadable materials, worksheets, journals, and similar resources are licensed for the purchaser’s personal, noncommercial use unless a different written license is clearly provided.

You may not sell, sublicense, publicly distribute, republish, reproduce for others, upload to file-sharing services, remove ownership notices from, or commercially exploit protected digital materials without written permission or another legal right that permits the use.

Digital-product delivery, technical problems, replacement access, and refund eligibility are governed by the Refund & Cancellation Policy. The current digital edition of The Betrayal & How I Continue to Overcome is configured for up to five downloads during a thirty-day access period. Those access limits do not reduce nonwaivable rights provided by applicable law.

8. INTELLECTUAL PROPERTY AND USER MATERIALS

Except for user-owned materials and third-party content, the Site and the Company’s original text, graphics, branding, books, journals, downloads, worksheets, forms, prompts, exercises, coaching frameworks, educational resources, and other original materials are owned by or licensed to the Company and are protected by applicable intellectual-property law.

No purchase or Site access transfers ownership of Company intellectual property. Any permitted use is limited to the license expressly provided with the applicable product or service.

You retain ownership of original journals, reflections, photographs, documents, messages, and other original materials you submit to the Company, subject to third-party rights. You grant the Company a limited, nonexclusive permission to access, copy, store, process, and use those materials only as reasonably necessary to provide the requested service, administer the Site or account, maintain legitimate records, comply with law, or establish, exercise, or defend legal rights.

Submitting material does not give the Company permission to use your name, voice, image, likeness, testimonial, identifiable personal story, direct quotation, or client-created work for public advertising or promotional purposes. Any such identifiable public or promotional use requires separate written authorization when required by law or Company policy.

9. PRIVACY, COOKIES, AND COMMUNICATIONS

Our Privacy Policy explains how we collect, use, store, disclose, and retain personal information and how privacy requests may be submitted. Use of the Site may involve cookies, local storage, analytics, consent-management tools, security technologies, and other processing described in that policy.

Service communications may be sent when reasonably necessary to complete a purchase, administer an account, schedule or provide a service, deliver requested information, address security, or respond to a request. Optional marketing communications are subject to the consent and opt-out rules described in the Privacy Policy and applicable law.

10. THIRD-PARTY SERVICES AND LINKS

The Site and Company services may use or link to third-party providers, including payment processors, hosting providers, analytics services, communications platforms, scheduling tools, social-media services, meeting platforms, and other technology providers.

Third parties may have their own terms, privacy notices, availability rules, and technical requirements. We do not control every aspect of a third party’s systems or policies. Nothing in this section eliminates any responsibility that applicable law does not permit the Company to disclaim.

11. INFORMATIONAL CONTENT, DISCLAIMERS, AND NO GUARANTEES

Website articles, self-reflection tools, quizzes, educational resources, and general information are provided for educational and informational purposes. They are not a substitute for individualized medical, mental-health, legal, financial, or other licensed professional advice.

We do not guarantee that the Site will always be uninterrupted, error-free, or available without temporary maintenance, vendor outages, security events, or technical problems. We may correct errors, update features, or discontinue free Site functions when reasonably necessary.

No disclaimer in these Terms excludes a warranty, remedy, or consumer right that applicable law does not permit us to exclude.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Company is not liable for indirect, incidental, special, consequential, or exemplary damages arising from use of the Site, a product, or Company services, or from a user’s independent decisions or actions.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, willful or wanton misconduct, or any statutory right, remedy, damage, attorney-fee right, warranty, or other liability that applicable law does not permit the parties to waive or limit.

Private coaching liability terms are additionally governed by the applicable signed Coaching Agreement.

13. SUSPENSION, ACCOUNT RESTRICTION, AND TERMINATION

We may suspend or restrict Site or account access when reasonably necessary to address unlawful conduct, fraud, security threats, credential misuse, harassment, threats, material infringement, repeated policy violations, system abuse, nonpayment related to a paid service, or another substantial violation of these Terms.

Suspension or termination of Site or account access does not automatically erase accrued payment obligations, completed purchases, intellectual-property restrictions, privacy records, dispute rights, or other provisions that by their nature continue after termination.

Private coaching suspension and termination are governed by the signed Coaching Agreement. Financial consequences of coaching termination are determined under that agreement and the Refund & Cancellation Policy, not by an automatic forfeiture created by these website Terms.

14. GOVERNING LAW AND DISPUTES

Ohio law governs these Terms and transactions with the Company to the extent permitted by law because the Company is organized and operates from Ohio. This choice of law does not waive a mandatory consumer protection that applicable law does not permit a consumer to waive.

For a dispute arising from Site use or a product transaction that is not governed by a separate signed agreement, the parties may bring an eligible matter in small claims court or another court with lawful jurisdiction. Where legally permitted, the parties consent to an appropriate state or federal court serving Summit County, Ohio, subject to any nonwaivable jurisdiction, venue, or consumer-protection rule.

Private coaching disputes are governed by the dispute-resolution provisions of the applicable signed Coaching Agreement. The current adult Private Coaching Agreement contains a separate individual arbitration provision with a thirty-day opt-out. These website Terms do not independently require arbitration or create a separate class-action waiver for ordinary Site or product disputes.

15. CHANGES TO THESE TERMS AND ELECTRONIC ACCEPTANCE

We may update these Terms when our Site, products, services, technology, or legal obligations change. The current version will be posted with a revised effective or updated date. Changes apply prospectively unless applicable law and a valid agreement permit otherwise.

A later website-policy change does not silently alter the financial, recording, dispute-resolution, or other material terms of an already-signed Coaching Agreement or a completed transaction. When renewed affirmative acceptance is legally required or reasonably appropriate for a material change, we may require it before further use of the affected feature or service.

A checkbox, button, electronic signature, or other electronic act adopted with intent to accept these Terms may serve as evidence of acceptance to the extent permitted by law. Electronic records and signatures are not denied legal effect solely because they are electronic. We may retain the applicable Terms version, timestamp, transaction record, acceptance record, and related audit information as business records.

16. STANDARD TERMS

If a provision of these Terms is determined to be unenforceable, the provision will be enforced to the maximum lawful extent or severed when permitted, and the remainder will continue in effect.

Failure to enforce a provision once does not waive later enforcement. You may not transfer an account, digital license, or contractual right to another person without written permission when the right is personal to you. The Company may assign these Terms to a lawful successor that assumes the relevant obligations in connection with a merger, reorganization, or sale of relevant business assets.

The Company is not in breach for a reasonable delay caused by events outside its reasonable control, including natural disasters, widespread outages, government action, severe illness, carrier disruption, or failure of critical third-party infrastructure. Any refund or cancellation rights arising from such an event remain governed by applicable law, the Refund & Cancellation Policy, and any applicable signed agreement.

For Site and product matters not governed by a separate signed agreement, these Terms, the Refund & Cancellation Policy, the Privacy Policy, and any clearly presented product-specific terms form the applicable agreement concerning those matters. A signed Coaching Agreement remains separately controlling for private coaching.
